1. Introduction

These Terms of Service ("Terms") govern all bookings, purchases, and participation in travel services provided by Hatti Hatti Treks and Expeditions Pvt. Ltd. ("the Company", "we", "our", or "us").

By booking any service with the Company, the Client acknowledges that they have read, understood, and agreed to be legally bound by these Terms.

2. Scope of Services

The Company provides professional tourism and adventure travel services within Nepal, including but not limited to:

  • Trekking Programs

  • Peak Climbing

  • Mountaineering Expeditions

  • Cultural Tours

  • Jungle Safaris

  • Adventure Activities

  • Sightseeing Tours

  • Private and Group Tours

  • Transportation Arrangements

  • Hotel Reservations

  • Airport Transfers

  • Trekking Logistics

  • Expedition Logistics

  • Licensed Guides and Porters

  • Other tourism-related services offered by the Company within Nepal.

Each booking shall be governed by these Terms together with the specific itinerary, quotation, and service confirmation issued by the Company.

3. Booking Confirmation

A booking shall be considered confirmed only when:

  • The required deposit or full payment has been received by the Company.

  • The Company issues written confirmation.

  • Required documents have been submitted by the Client.

  • Any required permits or governmental approvals are obtainable.

The Company reserves the right to refuse or decline any booking without obligation to disclose its reasons.

4. Pricing

Unless otherwise agreed in writing:

  • Prices are quoted in the agreed booking currency.

  • Prices are based on costs prevailing at the time of quotation.

  • Government taxes, park fees, permit charges, airline surcharges, exchange rate fluctuations, or regulatory changes may require price adjustments before departure.

  • Optional activities not specifically listed are excluded.

5. Payment Terms

Unless otherwise agreed in writing, the following payment schedule shall apply:

  • 30% of the total booking amount is required as a non-refundable bank deposit to confirm the booking.

  • The remaining 70% of the total booking amount must be paid in cash at the Company's office in Kathmandu prior to the commencement of the trek or other booked services.

Failure to complete the required payment before the commencement of the services may result in suspension or cancellation of the booking without liability on the part of the Company.

6. Deposit Policy

A 30% bank deposit is required to confirm all bookings and is strictly non-refundable. The deposit is used to secure permits, reservations, logistics, administrative arrangements, and other operational expenses associated with your booking. 

No exceptions shall apply unless otherwise required by applicable law or expressly agreed to by the Company in writing.

7. Cancellation by Client

If the Client cancels a confirmed booking:

  • Deposits remain non-refundable.

  • Amounts already paid to airlines, hotels, government authorities, transport providers, or other suppliers are non-refundable where such costs cannot be recovered.

  • Any recoverable balance, if applicable, shall be refunded after deducting all unrecoverable expenses, bank charges, and administrative costs.

Refund processing times may vary depending on third-party suppliers and banking procedures.

8. Cancellation by the Company

The Company may cancel or modify any tour due to:

  • Government restrictions

  • Natural disasters

  • Political instability

  • Civil unrest

  • Epidemics or pandemics

  • Security concerns

  • Weather conditions

  • Insufficient minimum participants

  • Operational necessity

  • Any event beyond reasonable control

Where practical, the Company may offer:

  • An alternative itinerary;

  • A rescheduled departure; or

  • A refund of recoverable amounts after deduction of non-recoverable third-party expenses.

9. Client Responsibilities

The Client shall:

  • Provide accurate personal information.

  • Hold valid passports and visas where required.

  • Comply with immigration and customs laws.

  • Follow all safety instructions.

  • Respect local culture, customs, and laws.

  • Maintain physical fitness appropriate for the chosen activity.

  • Inform the Company of any medical condition that may affect participation.

  • Carry prescribed personal medications.

  • Maintain appropriate travel insurance where required.

  • Follow the directions of guides and expedition leaders.

Failure to comply may result in removal from the trip without refund if necessary for safety or operational reasons.

10. Health and Medical Requirements

Adventure travel involves physical exertion and inherent risks.

The Client confirms that:

  • They are physically capable of participating.

  • They have disclosed relevant medical conditions before booking.

  • They accept responsibility for risks arising from undisclosed medical conditions.

The Company may decline participation if it reasonably believes doing so is necessary for the safety of the Client or others.

11. Travel Insurance

The Company strongly recommends that every Client obtain comprehensive travel insurance covering, where appropriate:

  • Medical treatment

  • Emergency evacuation

  • Helicopter rescue

  • Trip cancellation

  • Personal accident

  • Baggage loss

  • Flight delays

  • Personal liability

  • Adventure activities included in the itinerary

The Client remains responsible for obtaining suitable insurance unless expressly agreed otherwise in writing.

12. Assumption of Risk

Adventure tourism involves inherent risks, including but not limited to:

  • High altitude

  • Extreme weather

  • Rockfall

  • Snowfall

  • Avalanches

  • Landslides

  • Floods

  • Wildlife encounters

  • Transportation delays

  • Trail conditions

  • Illness

  • Injury

  • Death

By participating, the Client acknowledges and voluntarily accepts these inherent risks.

13. Company Responsibilities

The Company shall:

  • Deliver the services described in the confirmed itinerary with reasonable care and professional standards.

  • Arrange licensed guides, staff, and required logistics where applicable.

  • Obtain permits that are the Company's responsibility.

  • Exercise reasonable judgment regarding the safety of participants.

  • Take appropriate steps to assist clients during emergencies within the limits of available resources and prevailing conditions.

The Company's responsibility is limited to the services it directly provides or arranges under the confirmed booking.

14. Third-Party Service Providers

Certain services may be provided by independent third parties, including:

  • Airlines

  • Hotels

  • Transportation companies

  • Helicopter operators

  • Government authorities

  • National park authorities

  • Equipment suppliers

  • Local operators

The Company acts as an organizer or intermediary for such services where applicable and is not responsible for their independent acts, omissions, delays, cancellations, or service failures beyond the Company's reasonable control.

15. Itinerary Changes

Adventure travel requires flexibility.

The Company may modify:

  • Routes

  • Accommodation

  • Transportation

  • Guides

  • Daily schedules

  • Activities

where reasonably necessary due to safety, weather, operational, environmental, or regulatory reasons.

Such changes do not constitute a breach of contract.

16. Force Majeure

The Company shall not be liable for failure or delay in performing its obligations where caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters

  • Earthquakes

  • Floods

  • Fires

  • Epidemics

  • Pandemics

  • War

  • Terrorism

  • Government restrictions

  • Border closures

  • Airline disruptions

  • Civil unrest

  • Strikes

  • Power failures

  • Severe weather

  • Any comparable unforeseen event.

17. Client Conduct

The Company reserves the right to remove any Client from a tour if their conduct:

  • Endangers others.

  • Violates local laws.

  • Causes significant disruption.

  • Damages property.

  • Harasses staff or participants.

  • Is abusive, violent, discriminatory, or intoxicated to the extent that safety is compromised.

No refund shall be payable in such circumstances.

18. Personal Property

Clients remain solely responsible for safeguarding their personal belongings.

The Company shall not be liable for loss, theft, or damage to personal property except where required by applicable law.

19. Photography and Marketing

Unless the Client notifies the Company in writing before the tour begins, the Company may use photographs or videos taken during tours for promotional and marketing purposes without additional compensation.

20. Privacy

Personal information collected by the Company shall be used solely for:

  • Booking administration

  • Permit processing

  • Operational requirements

  • Legal compliance

  • Customer communication

The Company will take reasonable measures to protect personal information in accordance with applicable law.

21. Complaints

Clients should report any concerns immediately during the trip so that reasonable efforts can be made to address them.

Any formal complaint should be submitted in writing within 14 days after completion of the relevant services.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Nepal.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms, together with the confirmed itinerary, quotation, invoices, booking confirmation, and any written amendments issued by the Company, constitute the entire agreement between the Company and the Client.

25. Amendments

The Company reserves the right to amend these Terms at any time.

Updated Terms shall become effective upon publication or communication to Clients and shall apply to future bookings unless otherwise stated.
